X care modific\u0103 Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 195\/2002"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong><em>Rezumat<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0\u00a0\u00a0 <\/strong>Studiul analizeaz\u0103 conflictul de constitu\u0163ionalitate dintre unele dispozi\u0163ii ale legii nr. 202\/2010 privind unele m\u0103suri pentru accelerarea solu\u0163ion\u0103rii proceselor \u015fi prevederile Constitu\u0163iei Rom\u00e2niei, precum \u015fi oportunitatea acestor dispozi\u0163ii.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<em>\u00a0\u00a0 Cuvinte cheie:<\/em><\/strong><strong> <\/strong>Legea nr. 202\/2010, conven\u0163ionalitate, constitu\u0163ionalitate, oportunitate, concluzii \u015fi propuneri.<\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<ol style=\"text-align: justify;\">\n<li><em>1.\u00a0\u00a0\u00a0 <\/em><em>Scurt\u0103 prezentare a obiectului studiului<\/em><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/em>Prin intrarea \u00een vigoare a Legii nr. 202\/2010 privind unele m\u0103suri pentru accelerarea solu\u0163ion\u0103rii proceselor<a title=\"\" href=\"#_ftn1\">[1]<\/a> se modific\u0103 Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 195\/2002 (denumit\u0103 \u00een continuare Ordonan\u0163a) privind circula\u0163ia pe drumurile publice<a title=\"\" href=\"#_ftn2\">[2]<\/a>, \u00een sensul c\u0103 pl\u00e2ngerile contraven\u0163ionale formulate \u00eempotriva sanc\u0163iunilor aplicate la regimul circula\u0163iei pe drumurile publice sunt lipsite de calea ordinar\u0103 de atac a recursului, acesta devenind inadmisibil. Astfel, art. X alin. (2) din Legea nr. 202\/2010 care completeaz\u0103 art. 118 din Ordonan\u0163\u0103 are urm\u0103torul cuprins:<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ,,<em>La art. 118, dup\u0103 alineatul (3) se introduce un nou alineat, alineatul (3<sup>1<\/sup>), cu urm\u0103torul cuprins:<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(3<sup>1<\/sup>) Hot\u0103r\u00e2rea judec\u0103toreasc\u0103 prin care judec\u0103toria solu\u0163ioneaz\u0103 pl\u00e2ngerea este definitiv\u0103 \u015fi irevocabil\u0103.<\/em>\u201d<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Astfel, hot\u0103r\u00e2rea judec\u0103toriei, prin care se solu\u0163ioneaz\u0103 \u00een prim\u0103 \u015fi ultim\u0103 instan\u0163\u0103 pl\u00e2ngerea dedus\u0103 judec\u0103\u0163ii, este definitiv\u0103 \u015fi irevocabil\u0103. Hot\u0103r\u00e2rea judec\u0103toriei nu mai poate fi supus\u0103 controlului judiciar al instan\u0163ei superioare \u015fi, pe cale de consecin\u0163\u0103, nu mai poate fi cenzurat\u0103, modificat\u0103 prin nicio cale de atac ordinar\u0103. Conform textului de lege acest lucru nu ar \u00eempieta asupra posibilit\u0103\u0163ii petentului de a apela la c\u0103ile de atac extraordinare respectiv: contesta\u0163ia \u00een anulare \u015fi revizuire. ,,<em>Prin urmare, aceste hot\u0103r\u00e2ri sunt pronun\u0163ate de c\u0103tre judec\u0103torie \u00een prim\u0103 \u015fi ultim\u0103 instan\u0163\u0103, nemaifiind supuse niciunei c\u0103i de atac de reformare, fiind \u00eens\u0103 atacabile cu c\u0103i de atac de retractare, respectiv contesta\u0163ia \u00een anulare \u015fi revizuire<\/em>\u201d<a title=\"\" href=\"#_ftn3\">[3]<\/a>. Cu toate acestea, opinia noastr\u0103 este c\u0103 aceste c\u0103i de atac de retractare nu au o eficien\u0163\u0103 juridic\u0103 \u00eensemnat\u0103 pentru petent. Pe de o parte, ele sunt admisibile \u00een condi\u0163ii restrictive \u015fi limitativ prev\u0103zute de lege, iar pe de alt\u0103 parte procedurile sunt \u00eendelungate \u015fi p\u00e2n\u0103 la finalizarea lor, eventual \u00een favoarea petentului, hot\u0103r\u00e2rea judec\u0103toreasc\u0103 definitiv\u0103 \u015fi irevocabil\u0103 \u00ee\u015fi va fi produs efectele sanc\u0163ionatorii, lipsind posibilitatea unui remediu juridic eficace atunci c\u00e2nd s-ar constata c\u0103 aceast\u0103 din urm\u0103 hot\u0103r\u00e2re ar trebui desfiin\u0163at\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen aceast\u0103 situa\u0163ie s-ar putea afla peten\u0163ii c\u0103rora, de exemplu: li s-a suspendat temporar dreptul de a conduce autovehiculele pe drumurile publice, dreptul de a circula cu un anumit autovehicul pe drumurile publice prin re\u0163inerea certificatului de \u00eenmatriculare etc.<\/p>\n<ol style=\"text-align: justify;\">\n<li><em>2.\u00a0\u00a0\u00a0 <\/em><em>Conven\u0163ionalitatea dispozi\u0163iilor art. X alin. 2 din Legea 202\/2010\u00a0 privind unele m\u0103suri pentru accelerarea solu\u0163ion\u0103rii proceselor<\/em><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Se impune s\u0103 analiz\u0103m dac\u0103 dispozi\u0163iile men\u0163ionate mai sus ar putea intra \u00een conflict cu normele impuse de Conven\u0163ia (european\u0103) pentru ap\u0103rarea drepturilor omului \u015fi a libert\u0103\u0163ilor fundamentale (denumit\u0103 \u00een continuare Conven\u0163ia)<a title=\"\" href=\"#_ftn4\">[4]<\/a>, precum \u015fi cu jurispruden\u0163a Cur\u0163ii Europene a Drepturilor Omului (denumit\u0103 \u00een continuare Curtea). \u00cen ceea ce prive\u015fte for\u0163a juridic\u0103 a Conven\u0163iei \u00eempreun\u0103 cu jurispruden\u0163a Cur\u0163ii nu sunt dificult\u0103\u0163i de interpretare. Astfel, \u00een ceea ce prive\u015fte Rom\u00e2nia potrivit art. 11 alin (2) din Constitu\u0163ia Rom\u00e2niei revizuit\u0103 ,,<em>tratatele ratificate de Parlament, potrivit legii, fac parte din dreptul intern.<\/em>\u201d Conven\u0163ia a fost ratificat\u0103 de Rom\u00e2nia prin Legea nr. 30 din 18 mai 1994.<a title=\"\" href=\"#_ftn5\">[5]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 De asemenea, potrivit dispozi\u0163iilor art. 20 alin. (2) din Constitu\u0163ia Rom\u00e2niei, \u00een cazul neconcordan\u0163ei \u00eentre reglement\u0103rile interna\u0163ionale \u015fi legile interne cu privire la drepturile fundamentale ale omului, prioritate au reglement\u0103rile interna\u0163ionale, cu excep\u0163ia cazului \u00een care Constitu\u0163ia sau legile interne con\u0163in dispozi\u0163ii mai favorabile.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ,,<em>&#8230;modul de \u00eencorporare a dispozi\u0163iilor Conven\u0163iei europene \u00een legisla\u0163ia intern\u0103, ca regul\u0103 general\u0103, normele juridice interna\u0163ionale \u00een materia drepturilor omului sunt direct aplicabile \u00een dreptul intern, deoarece acestea au ca beneficiari indivizii. De exemplu, Conven\u0163ia european\u0103 \u00een art. 1 con\u0163ine direct obliga\u0163ia statelor de a respecta drepturile omului: \u00cenaltele p\u0103r\u0163i contractante recunosc oric\u0103rei persoane \u0163in\u00e2nd de jurisdic\u0163ia, lor drepturile \u015fi libert\u0103\u0163ile definite \u00een titlul I al prezentei Conven\u0163ii.\u201d<a title=\"\" href=\"#_ftn6\"><strong>[6]<\/strong><\/a><\/em><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Deopotriv\u0103, trebuie avut \u00een vedere c\u0103 ,,&#8230;<em>prevederile Conven\u0163iei \u015fi ale protocoalelor sale adi\u0163ionale nu pot fi interpretate \u015fi aplicate \u00een mod corect dec\u00e2t prin raportare la jurispruden\u0163a Cur\u0163ii.<\/em>\u201d<a title=\"\" href=\"#_ftn7\">[7]<\/a> ,,&#8230;<em>se poate afirma c\u0103 normele cuprinse \u00een Conven\u0163ie \u015fi \u00een protocoalele sale adi\u0163ionale alc\u0103tuiesc, \u00eempreun\u0103 cu jurispruden\u0163a organelor sale, un bloc de conven\u0163ionalitate (&#8230;) jurispruden\u0163a Cur\u0163ii Europene este direct aplicabil\u0103 \u00een sistemul rom\u00e2n de drept; are for\u0163\u0103 constitu\u0163ional\u0103 \u015fi supralegislativ\u0103.\u201d<\/em><a title=\"\" href=\"#_ftn8\">[8]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Prin urmare, partea interesat\u0103 ce consider\u0103 c\u0103 modific\u0103rile aduse Ordonan\u0163ei\u00a0\u00a0 \u00eencalc\u0103 normele Conven\u0163iei \u015fi jurispruden\u0163a Cur\u0163ii poate invoca o excep\u0163ie de neconven\u0163ionalitate \u00een fa\u0163a instan\u0163ei judec\u0103tore\u015fti na\u0163ionale. Aceasta din urm\u0103 (instan\u0163a), este obligat\u0103 s\u0103 se pronun\u0163e prin admiterea excep\u0163iei dac\u0103 constat\u0103 \u00eenc\u0103lcarea drepturilor con\u0163inute \u00een textul Conven\u0163iei \u015fi a protocoalelor adi\u0163ionale, \u00eentruc\u00e2t Conven\u0163ia \u015fi jurispruden\u0163a Cur\u0163ii constituie izvor de drept cu caracter obligatoriu pentru instan\u0163ele judec\u0103tore\u015fti na\u0163ionale.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Articolul 6 din Conven\u0163ie consfin\u0163e\u015fte dreptul la un proces echitabil al fiec\u0103rei persoane, indiferent de natura drepturilor \u015fi obliga\u0163iilor sale, at\u00e2t \u00een materie civil\u0103 c\u00e2t \u015fi \u00een <em>materie penal\u0103.<\/em><\/p>\n<p style=\"text-align: justify;\">Cu privire la aceste dispozi\u0163ii, trebuie precizat c\u0103, Conven\u0163ia nu a definit no\u0163iunea de acuza\u0163ie \u00een <em>materie penal\u0103,<\/em> \u00een schimb Curtea prin jurispruden\u0163a sa repetat\u0103 \u015fi constant\u0103, a ar\u0103tat c\u0103 aceast\u0103 no\u0163iune are un caracter autonom, distinct fa\u0163\u0103 de ceea ce statele prin legile lor interne au stabilit c\u0103 o acuza\u0163ie este sau nu de natur\u0103 penal\u0103. Criteriile dup\u0103 care Curtea stabile\u015fte dac\u0103 ne afl\u0103m \u00een prezen\u0163a unei acuza\u0163ii \u00een <em>materie penal\u0103<\/em> sunt urm\u0103toarele:<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ,,..<em>.Curtea a stabilit, \u00een jurispruden\u0163a sa, urm\u0103toarele trei criterii: a) calificarea ei ca infrac\u0163iune \u00een legea ei na\u0163ional\u0103; b) natura infrac\u0163iunii; c) natura \u015fi gradul de gravitate ale sanc\u0163iunii ce urmeaz\u0103 a fi aplicate autorului ei.<\/em>\u201d<a title=\"\" href=\"#_ftn9\">[9]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Se cuvine a fi f\u0103cute dou\u0103 scurte preciz\u0103ri: \u00een ceea ce prive\u015fte cel de-al treilea criteriu interpretarea corect\u0103 este c\u0103 se are \u00een vedere natura \u015fi gradul de severitate al sanc\u0163iunii ce poate fi aplicat\u0103 \u015fi nu cea efectiv aplicat\u0103<a title=\"\" href=\"#_ftn10\">[10]<\/a>; criteriile men\u0163ionate nu trebuiesc \u00eendeplinite cumulativ \u00een condi\u0163iile \u00een care analiza separat\u0103 a fiec\u0103reia dintre ele duce la o concluzie clar\u0103 \u00een ceea ce prive\u015fte existen\u0163a unei acuza\u0163ii \u00een <em>materie penal\u0103<\/em>. Curtea are \u00een vedere ,,&#8230;<em>faptele ale c\u0103ror autori se expun la pedepse destinate \u00een special s\u0103 exercite un efect disuasiv \u015fi care consist\u0103, de regul\u0103 \u00een m\u0103suri privative de libertate \u015fi \u00een amenzi&#8230;<\/em>\u201d<a title=\"\" href=\"#_ftn11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Referitor la obiectivul studiului, consecin\u0163ele modific\u0103rii Ordonan\u0163ei, ar\u0103t\u0103m c\u0103 ,,&#8230;<em>chiar dac\u0103 fapta a fost dezincriminat\u0103 \u00een dreptul intern (Danemarca), procedura privitoare la nerespectarea normelor privind sta\u0163ionarea autovehiculelor, datorit\u0103 caracterului general al acestor norme \u015fi scopului at\u00e2t preventiv, c\u00e2t \u015fi represiv al sanc\u0163iunii aplicate, reprezint\u0103, toate, acuza\u0163ii \u00een materie penal\u0103, \u00een sensul Conven\u0163iei.<\/em>\u201d<a title=\"\" href=\"#_ftn12\">[12]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ,,<em>Referitor la gravitatea aceleia\u015fi sanc\u0163iuni, instan\u0163a europeanp\u0103 a re\u0163inut c\u0103 retragerea de puncte poate antrena retragerea permisului de conducere, \u00een anumite situa\u0163ii, de regul\u0103 const\u00e2nd \u00een acumularea unui num\u0103r prestabilit de puncte pierdute. Or, este incontestabil c\u0103 dreptul de a conduce un vehicul este de mare utilitate pentru via\u0163a curent\u0103 a oric\u0103rei persoane sau pentru exerci\u0163iul unei activit\u0103\u0163i profesionale. De aceea, at\u00e2t fosta Comisie, c\u00e2t \u015fi Curtea au ajuns la concluzia c\u0103 m\u0103sura retragerii de puncte \u00een materie de conducere auto are at\u00e2t un caracter preventiv, dar \u015fi un caracter punitiv \u015fi disuasiv, specific pedepselor accesorii. Voin\u0163a legiuitorului na\u0163ional de a disocia sanc\u0163iunile discutate de alte pedepse, ce pot fi pronun\u0163ate \u00een materie de c\u0103tre judec\u0103torul na\u0163ional, nu-i poate schimba natura juridic\u0103 de acuza\u0163ie \u00een materie penal\u0103.<\/em>\u201d<a title=\"\" href=\"#_ftn13\">[13]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Rezult\u0103 deci c\u0103, cel pu\u0163in \u00een aceste dou\u0103 situa\u0163ii men\u0163ionate, Curtea consider\u0103 c\u0103 ne afl\u0103m \u00een prezen\u0163a unei <em>acuza\u0163ii \u00een materie penal\u0103, <\/em>iar aceste sanc\u0163iuni analizate au ca sediu al materiei, \u00een legisla\u0163ia intern\u0103, Ordonan\u0163a, cu alte cuvinte, aceasta reglemeteaz\u0103, \u00een anumite situa\u0163ii \u015fi \u00een <em>materie penal\u0103<\/em> a\u015fa cum interpreteaz\u0103 Curtea.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Conven\u0163ia prevede, \u00een mod distinct, \u015fi dreptul persoanelor la un recurs efectiv \u00een fa\u0163a instan\u0163elor judec\u0103tore\u015fti. Acest lucru impune statelor \u00cenalte p\u0103r\u0163i contractante s\u0103 permit\u0103 prin legea intern\u0103 dreptul persoanei interesate s\u0103 poat\u0103 adresa instan\u0163elor na\u0163ionale orice pl\u00e2ngere, cerere, \u015fi dac\u0103 este necesar repara\u0163ia corespunz\u0103toare a prejudiciului ce pretinde c\u0103 i-ar fi fost adus. ,,..<em>.impunerea existen\u0163ei unui recurs intern prin care instan\u0163a na\u0163ional\u0103 competent\u0103 este investit\u0103 cu examinarea con\u0163inutului pl\u00e2ngerii \u00eentemeiate pe Conven\u0163ie \u015fi, \u00een plus, urm\u0103re\u015fte s\u0103 ofere victimei redresarea apropriat\u0103 a urm\u0103rilor \u00eenc\u0103lc\u0103rii constatate.<\/em>\u201d<a title=\"\" href=\"#_ftn14\">[14]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Este necesar s\u0103 ar\u0103t\u0103m c\u0103, pe de o parte art. 13 al Conven\u0163ei ce prevede dreptul la un recurs efectiv nu are o existen\u0163\u0103 independent\u0103 \u015fi poate fi invocat doar \u00een condi\u0163iile \u00een care este \u00eenc\u0103lcat un drept recunoscut de Conven\u0163ie sau de protocoalele sale adi\u0163ionale \u015fi nu de alte drepturi ce sunt oferite de alte acte normative interna\u0163ionale sau interne. Pe de alt\u0103 parte, exigen\u0163a dreptului la un recurs efectiv este \u00eendeplinit\u0103 chiar dac\u0103 legisla\u0163ia intern\u0103 nu prevede mai multe c\u0103i de atac. Pe cale de consecin\u0163\u0103, pl\u00e2ngerea contraven\u0163ional\u0103 \u00eempotriva unei sanc\u0163iuni dispuse de Ordonan\u0163\u0103, analizat\u0103 de judec\u0103torie, reprezint\u0103 prin ea \u00eens\u0103\u015fi un recurs efectiv, chiar dac\u0103 hot\u0103r\u00e2rea judec\u0103toreasc\u0103 este lipsit\u0103 de c\u0103ile de atac ordinare.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Av\u00e2nd \u00een vedere problemele analizate, privitoare la drepturile \u015fi libert\u0103\u0163ile garantate de Conven\u0163ie le corobor\u0103m \u015fi cu art. 2 din Protocolul nr. 7 la Conven\u0163ia pentru ap\u0103rarea drepturilor omului \u015fi a libert\u0103\u0163ilor fundamentale (denumit \u00een continuare Protocolul)<a title=\"\" href=\"#_ftn15\">[15]<\/a>. Protocolul garanteaz\u0103 dreptul la dublul grad de jurisdic\u0163ie \u00een <em>materie penal\u0103, <\/em>este de precizat c\u0103, \u015fi \u00een acest caz, se are \u00een vedere no\u0163iunea de acuza\u0163ie penal\u0103 a\u015fa cum este re\u0163inut\u0103 \u015fi definit\u0103 de c\u0103tre Curte, cu caracter autonom, independent de dispozi\u0163iile sistemelor de drept na\u0163ionale ale statelor membre ale Conven\u0163iei. Cu toate acestea, ,,&#8230;<em>nu orice condamnare penal\u0103 confer\u0103 dreptul la un dublu grad de jurisdic\u0163ie, aceasta pe de o parte; pe de alt\u0103 parte, statelor contractante le este recunoscut\u0103, \u00een principiu, o larg\u0103 putere de apreciere \u00een a decide \u00eense\u015fi modalit\u0103\u0163ile de exercitare a dreptului \u00een discu\u0163ie.\u201d<a title=\"\" href=\"#_ftn16\"><strong>[16]<\/strong><\/a><\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/em>Dispozi\u0163iile art. 2 al Protocolului sustrag, \u00een mod expres, posibilitatea petentului de aplicare a principiului dublului grad de jurisdic\u0163ie \u00een <em>materie penal\u0103<\/em>, \u00een condi\u0163iile existen\u0163ei unei infrac\u0163iuni minore. Principalul criteriu de apreciere c\u0103 o infrac\u0163iune este minor\u0103 este dac\u0103 aceasta este sau nu pedepsit\u0103 cu sanc\u0163iunea \u00eenchisorii. Dispozi\u0163iile Ordonan\u0163ei nu prev\u0103d ca fiind posibil\u0103 o sanc\u0163iune privativ\u0103 de libertate aplicat\u0103 persoanei ce se face vinovat\u0103 de \u00eenc\u0103lcarea lor. Deopotriv\u0103, trebuie ar\u0103tat \u015fi c\u0103, Constitu\u0163ia Rom\u00e2niei revizuit\u0103 \u00een 2003 dispune \u00een art. 23 alin. (13) ,,<em>sanc\u0163iunea privativ\u0103 de libertate nu poate fi dec\u00e2t de natur\u0103 penal\u0103<\/em>\u201d. Preciz\u0103m c\u0103, de data aceasta, natura penal\u0103 a sanc\u0163iunii nu are conota\u0163ia conferit\u0103 \u00een mod autonom de Conven\u0163ie a unei acuza\u0163ii \u00een <em>materie penal\u0103,<\/em> ci dimpotriv\u0103 ea se refer\u0103 doar la dispozi\u0163iile \u00een <em>materie penal\u0103<\/em> reglemetate de Codul Penal al Rom\u00e2niei \u015fi celelalte legi ce con\u0163in\u00a0 sanc\u0163iuni de natur\u0103 penal\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Reunind\u00a0 \u015fi corobor\u00e2nd toate aceste aspecte, opin\u0103m c\u0103 este greu de crezut c\u0103 instan\u0163ele judec\u0103tore\u015fti, competente \u00een solu\u0163ionarea unei excep\u0163ii de neconven\u0163ionalitate a dispozi\u0163iei cuprinse \u00een Legea nr. 202\/2010 ce modific\u0103 Ordonan\u0163a, ar admite o astfel de cerere \u00een sensul c\u0103 ar fi potrivnice blocului de conven\u0163ionalitate al Conven\u0163iei \u015fi jurispruden\u0163ei Cur\u0163ii.<\/p>\n<p style=\"text-align: justify;\"><em>3. Constitu\u0163ionalitatea<\/em> <em>dispozi\u0163iilor art. X alin. 2 din Legea 202\/2010\u00a0 privind unele m\u0103suri pentru accelerarea solu\u0163ion\u0103rii proceselor<\/em><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen ceea ce prive\u015fte posibilul conflict \u00eentre dispozi\u0163iile din Constitu\u0163ia Rom\u00e2niei \u015fi cele ce rezult\u0103 din modificarea Ordonan\u0163ei opin\u0103m c\u0103\u00a0 avem un argument pertinent \u015fi serios \u00een a re\u0163ine c\u0103 acesta exist\u0103. Astfel, art. 129 din Constitu\u0163ia Rom\u00e2niei prevede c\u0103 ,,<em>\u00eempotriva hot\u0103r\u00e2rilor judec\u0103tore\u015fti p\u0103r\u0163ile interesate \u015fi Ministerul Public pot exercita c\u0103ile de atac, \u00een condi\u0163iile legii<\/em>.\u201d ,,<em>Renun\u0163area la calea de atac a apelului \u015fi recursului ar putea fi considerat\u0103 \u00een viitor ca excesiv\u0103. A\u015fa fiind, un control de constitu\u0163ionalitate promovat din ini\u0163iativa uneia din p\u0103r\u0163i nu poate fi exclus \u00een viitor \u015fi el s-ar putea fundamenta chiar pe dispozi\u0163iile art. 129 din Constitu\u0163ia Rom\u00e2niei.<\/em>\u201d<a title=\"\" href=\"#_ftn17\">[17]<\/a> Autorul se refer\u0103 la dispozi\u0163iile Legii nr. 202\/2010 ce privesc modific\u0103rile \u015fi complet\u0103rile aduse Codului de procedur\u0103 civil\u0103. Nu vedem nici un motiv pentru care, \u00een baza aceluia\u015fi argument, o cerere dedus\u0103 judec\u0103\u0163ii Cur\u0163ii Constitu\u0163ionale a Rom\u00e2niei s\u0103 nu fie admisibil\u0103 \u015fi \u00een cazul modific\u0103rii Ordonan\u0163ei. \u00cen opinia noastr\u0103 exist\u0103 identitate de ra\u0163iune \u00een argumentul invocat \u00een ambele situa\u0163ii, iar <em>ubi eadem est ratio ibi eadem solutio esse debet<\/em> .<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen concluzie, consider\u0103m c\u0103 \u00een cadrul unui control de constitu\u0163ionalitate al Legii nr. 202\/2010 care modific\u0103 Ordonan\u0163a, Curtea Constitu\u0163ional\u0103 va trebui s\u0103 pronun\u0163e \u00een sensul constat\u0103rii neconstitu\u0163ionalit\u0103\u0163ii prevederilor acesteia. Dispozi\u0163iile art. 129 din Constitu\u0163ia Rom\u00e2niei trebuiesc interpretate c\u0103 \u00eempotriva oric\u0103rei hot\u0103r\u00e2ri judec\u0103tore\u015fti, <em>ubi lex non distinguit nec nos distinguere debemus, <\/em>se pot exercita c\u0103i de atac de c\u0103tre p\u0103r\u0163ile interesate \u015fi ministerul public.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Modificarea legislativ\u0103 discutat\u0103 derog\u0103 de la principiul disponibilit\u0103\u0163ii exercit\u0103rii <em>oric\u0103rei c\u0103i de atac<\/em> \u00eempotriva <em>oric\u0103rei hot\u0103r\u00e2ri judec\u0103tore\u015fti<\/em> definitive \u015fi irevocabile, dat\u0103 \u00een prim\u0103 \u015fi ultim\u0103 instan\u0163\u0103 de c\u0103tre judec\u0103torii.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Totodat\u0103, sintagma <em>\u00een condi\u0163iile legii <\/em>nu poate fi interpretat\u0103 \u00een sensul c\u0103 legea poate stabili dac\u0103 se pot sau nu exercita c\u0103i de atac \u00eempotriva hot\u0103r\u00e2rilor judec\u0103tore\u015fti, ci \u00een sensul c\u0103 exercitarea acestora se va face \u00een limitele \u015fi condi\u0163iile stabilite prin lege (p\u0103r\u0163i, termene de exercitare, forma scris\u0103, motive de fapt \u015fi de drept etc). \u00cen caz contrar, dispozi\u0163iile art. 129 ar fi considerate neobligatorii \u015fi op\u0163ionale pentru legiuitor, fapt ce ar compromite \u00een mod serios eficien\u0163a \u015fi for\u0163a juridic\u0103 supralegislativ\u0103 a Constitu\u0163iei Rom\u00e2niei.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen alt\u0103 ordine de idei, dispozi\u0163iile Legii nr. 202\/2010 nu sunt la ad\u0103post de orice critic\u0103 \u00een ceea ce prive\u015fte posibila interpretare de nerespectare a principiului constitu\u0163ional al neretroactivit\u0103\u0163ii legii \u00een cazul proceselor aflate \u00een faza de judecat\u0103 \u015fi care au fost \u00eencepute \u00eenaintea intr\u0103rii \u00een vigoare a prezentelor reglement\u0103ri.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Legiuitorul nu dispune <em>expresis terminis<\/em> dac\u0103 procesele aflate \u00een curs de solu\u0163ionare pe rolul instan\u0163elor de judecat\u0103 se vor desf\u0103\u015fura sub imperiul dispozi\u0163iilor anterioare sau dimpotriv\u0103 a celor instituite de Legea nr. 202\/2010.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Putem observa c\u0103 exist\u0103 preciz\u0103ri asupra aplic\u0103rii prezentei legi doar \u00een ceea ce prive\u015fte modific\u0103rile Codului de procedur\u0103 civil\u0103, Codului de procedur\u0103 penal\u0103, Dreptului familiei \u015f.a.m.d. dar nu \u015fi \u00een ceea ce prive\u015fte solu\u0163ionarea pl\u00e2ngerilor contraven\u0163ionale \u00een materia reglementat\u0103 de Ordonan\u0163\u0103.<\/p>\n<ol style=\"text-align: justify;\">\n<li><em>4.\u00a0\u00a0\u00a0 <\/em><em>Concluzii \u015fi propuneri<\/em><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Consider\u00e2nd problematica ridicat\u0103 de dispozi\u0163iile Legii 202\/2010 care modific\u0103 Ordonan\u0163a, c\u00e2t \u015fi aspectele prezentate p\u00e2n\u0103 acum, ne exprim\u0103m serioase rezerve \u00een ceea ce prive\u015fte at\u00e2t oportunitatea acestora, dar mai ales conformitatea lor, necesar\u0103 \u015fi obligatorie, cu dispozi\u0163iile Constitu\u0163iei Rom\u00e2niei. \u00cen conformitate cu aceasta, chiar \u015fi atunci c\u00e2nd un tratat interna\u0163ional cuprinde dispozi\u0163ii contrare Constitu\u0163iei, ratificarea lui, \u015fi drept urmare asumarea obliga\u0163iilor ce revin statului din aceasta, poate avea loc numai dup\u0103 revizuirea Constitu\u0163iei.<em> A fortiori rationae,<\/em> dac\u0103 un tratat interna\u0163ional nu poate contraveni dispozi\u0163iilor Constitu\u0163iei, cu at\u00e2t mai mult nu poate s\u0103 o fac\u0103 nici o lege na\u0163ional\u0103 \u00een sensul larg al accep\u0163iunii juridice de lege.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Exist\u0103 argumente pertinente care arat\u0103 c\u0103 este necesar\u0103 garantarea unei c\u0103i de atac \u00eempotriva unei hot\u0103r\u00e2ri judec\u0103tore\u015fti. ,,.<em>..deoarece consta \u00eentr-o pl\u00e2ngere contra erorii, ne\u015ftiin\u0163ei sau nedrept\u0103\u0163ii comise de judec\u0103torii inferiori a fost privit la \u00eenceput ca o cale nereveren\u0163ioas\u0103 fa\u0163\u0103 de ace\u015ftia. Necesitatea apelului a fost contestat\u0103 sau ap\u0103rat\u0103, pentru ca p\u00e2n\u0103 la urm\u0103 s\u0103 se impun\u0103 ca garan\u0163ie pentru justi\u0163iabili \u015fi un mijloc de a men\u0163ine judec\u0103torii \u00eentr-un profund respect fa\u0163\u0103 de lege.<\/em>\u201d<a title=\"\" href=\"#_ftn18\">[18]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ,,.<em>..mai \u00eent\u00e2i apelul permite a se corija eroarea sau nedreptatea care se poate strecura \u00een hot\u0103r\u00e2rea primilor judec\u0103tori (&#8230;) dreptul de apel al p\u0103r\u0163ilor este \u015fi o puternic\u0103 excita\u0163iune pentru judec\u0103tori de a-\u015fi da toate silin\u0163ele ca s\u0103 judece bine.<\/em>\u201d<a title=\"\" href=\"#_ftn19\">[19]<\/a><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Cu alte cuvinte au existat, chiar cu sute de ani \u00eenainte, preocup\u0103ri \u015fi argumente care atest\u0103 necesitatea existen\u0163ei unei c\u0103i de atac eficiente, reformatoare, care s\u0103 asigure \u00eendreptarea hot\u0103r\u00e2rilor judec\u0103tore\u015fti \u015fi evitarea erorilor judiciare. Pe de alt\u0103 parte, principiul controlului judiciar este un principiu de la care consider\u0103m c\u0103 ar fi util s\u0103 nu se deroge, asigur\u00e2nd astfel garantarea dreptului justi\u0163iabilului la un proces just \u015fi echitabil.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Totodat\u0103, trebuie analizat at\u00e2t <em>ratio legis<\/em> al prevederilor discutate c\u00e2t \u015fi scopul economic \u015fi social avut \u00een vedere la edictarea acestor norme. Dup\u0103 cum u\u015for se poate constata, dispozi\u0163iile Legii nr. 202\/2010 cu privire la modificarea Ordonan\u0163ei au drept scop declarat accelerarea proceselor \u015fi drept consecin\u0163\u0103 celeritatea lor, dar de fapt au \u00een vedere degrevarea instan\u0163elor de o parte din num\u0103rul \u00eensemnat de cereri adresate justi\u0163iei. Credem c\u0103, av\u00e2nd \u00een vedere, a\u015fa cum am precizat anterior, posibilitatea justi\u0163iabilului de a promova c\u0103ile extraordinare de atac, acest scop nu este realizat.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen ceea ce prive\u015fte justi\u0163iabilul, consider\u0103m c\u0103 legea nu dispune \u00een interesul lui, priv\u00e2ndu-l de garan\u0163ia exercit\u0103rii c\u0103ilor de atac \u015fi de ob\u0163inerea unor hot\u0103r\u00e2ri judec\u0103tore\u015fti mai adecvate \u00eemprejur\u0103rilor de fapt \u015fi de drept. Trebuie avut \u00een vedere c\u0103 dreptul nu trebuie s\u0103 dispun\u0103 pentru sine \u00eensu\u015fi sau pentru autoritatea judec\u0103toresc\u0103, ci \u00een primul r\u00e2nd pentru justi\u0163iabili.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Nu este de neglijat nici aspectul relevat \u00een repetate r\u00e2nduri, de jurispruden\u0163a Cur\u0163ii, de Comisia European\u0103 \u015fi recunoscut de autorit\u0103\u0163ile na\u0163ionale, deciziile \u00een recursuri \u00een interesul legii ale \u00cenaltei Cur\u0163i de Casa\u0163ie \u015fi Justi\u0163ie, CSM \u015f.a.m.d., referitor la practica neunitar\u0103, suficient de \u00eengrijor\u0103toare, a instan\u0163elor de judecat\u0103 din Rom\u00e2nia.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00cen condi\u0163iile modific\u0103rilor legislative criticate se poate ajunge u\u015for la situa\u0163ii \u00een care dou\u0103 cereri similare, adresate judec\u0103toriilor, pot fi solu\u0163ionate total diferit, \u00een sens contrar una fa\u0163\u0103 de cealalt\u0103, f\u0103r\u0103 posibilitatea reform\u0103rii lor.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Av\u00e2nd \u00een vedere motivele expuse, propunem ca aceast\u0103 modificare s\u0103 fie abrogat\u0103 ca fiind neoportun\u0103 \u015fi inadecvat\u0103 pentru sistemul judec\u0103toresc din Rom\u00e2nia.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Deopotriv\u0103, consider\u0103m c\u0103, Curtea Constitu\u0163ional\u0103, \u00een cazul sesiz\u0103rii sale asupra neconstitu\u0163ionalit\u0103\u0163ii dispozi\u0163iilor analizate, va trebui s\u0103 constate lipsa de conformitate a acestora cu prevederile Constitu\u0163iei \u015fi drept urmare suspendarea lor de drept \u015fi, \u00een fine, \u00eencetarea efectelor juridice ale acestora la 45 de zile de la publicarea Deciziei.<\/p>\n<p style=\"text-align: justify;\" align=\"center\"><strong>BIBLIOGRAFIE<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Atasiei D., \u0162i\u0163 H, (2010), <em>Mica Reform\u0103 \u00een Justi\u0163ie.
