Transpunerea procedurilor de transparen\u0163\u0103 decizional\u0103 \u00een Administra\u0163ia public\u0103"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> INTRODUCERE<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Prezenta lucrare \u00ee\u015fi propune s\u0103 eviden\u0163ieze \u015fi s\u0103 analizeze procedurile de transparen\u0163\u0103 decizional\u0103 \u00een administra\u0163ia public\u0103 din Rom\u00e2nia.De asemenea trateaz\u0103 \u015fi modalit\u0103\u0163ile de \u00eembun\u0103t\u0103\u0163ire a rela\u0163iei:administra\u0163ie public\u0103 \u2013 cet\u0103\u0163ean.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00cen acest scop vom incerca s\u0103 clarific\u0103m conceptul de transparen\u0163\u0103 decizional\u0103 \u015fi metodele concrete prin care acesta este transpuns \u00een realitate.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Transparen\u0163a urm\u0103re\u015fte asigurarea unui acces mai larg al cet\u0103\u0163enilor la informa\u0163iile \u015fi documentele aflate \u00een posesia institu\u0163iilor statului, participarea cet\u0103\u0163enilor la procesul decizional \u015fi asigurarea legitimit\u0103tii, eficacit\u0103\u0163ii \u015fi responsabilit\u0103\u0163ii administra\u0163iei fa\u0163\u0103 de cet\u0103\u0163ean. Conceptul de transparen\u0163\u0103 a procesului decizional derulat \u00een institu\u0163ii se refer\u0103 la asigurarea accesului cet\u0103\u0163enilor la documentele aflate \u00een gestiunea institu\u0163iilor statului precum \u015fi la consultarea cet\u0103\u0163enilor cu privire la adoptarea unor reglement\u0103ri. Transparen\u0163a, \u00een sens larg, se refer\u0103 la accesul liber la informa\u0163ie de orice fel, la posibilitatea de a opta sub orice form\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Prin aceast\u0103 lucrare ne-am propus s\u0103 cercet\u0103m m\u0103sura \u00een care autorit\u0103\u0163ile \u015fi institu\u0163iile publice aplic\u0103 prevedeile legii nr 544\/2001 \u00een litera \u015fi spiritul s\u0103u. Aceast\u0103 lege este deosebit de important\u0103 deoarece reglementeaz\u0103 primul contact dintre autorit\u0103tile publice \u015fi cet\u0103teni. \u00cen acest sens se poate vorbi de transparentizarea si responsabilizarea institu\u0163iilor publice \u015fi participarea cet\u0103\u0163enilor la procesul de luare a deciziilor.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">De asemenea, \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00eencerc\u0103m s\u0103 definim \u015fi procesul de optimizare a performan\u0163elor institu\u0163iilor publice din perspectiva liberului acces la informa\u0163ii de interes public.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Vom trata aceasta tem\u0103 din\u00a0 perspectiva legislativ-normativ\u0103 oferind un cadru care permite asigurarea \u015fi aplicarea principiului suprema\u0163iei legii, respectiv a egalit\u0103\u0163ii de tratament fa\u0163\u0103 de public, a cet\u0103\u0163enilor \u00een fa\u0163a legii \u015fi tratamentul nediscriminatoriu al lor, apreciat de teoreticieni \u015fi practicieni \u00een egal\u0103 m\u0103sur\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> <\/strong><strong>Reglement\u0103rile de baz\u0103 privind liberul acces la informa\u0163iile de interes public<\/strong> :<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u25cf <strong><em>Declara\u0163ia Universal\u0103 a Drepturilor Omului, articolul 19<\/em><\/strong> : &#8222;Orice persoan\u0103 are dreptul la libertatea opiniei \u015fi a expresiei, acest drept include libertatea de a sus\u0163ine opinii f\u0103r\u0103 nicio interferen\u0163\u0103 \u015fi de a cauta, primi \u015fi r\u0103sp\u00e2ndi informa\u0163ii \u015fi idei prin orice mijloc, indiferent de frontiere.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u25cf <strong><em>Constitu\u0163ia Rom\u00e2niei, articolul 31<\/em><\/strong> : &#8222;Dreptul persoanei de a avea acces la orice informa\u0163ie de interes public nu poate fi \u00eengradit&#8230; Autorit\u0103\u0163ile publice, potrivit competen\u0163elor ce le revin, sunt obligate s\u0103 asigure informarea corect\u0103 a cet\u0103\u0163enilor asupra treburilor publice \u015fi asupra problemelor de interes personal.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u25cf <strong><em>Legea nr. 544\/2001 privind liberul acces la informa\u0163iile de interes public<\/em><\/strong> : &#8221; Accesul liber \u015fi ne\u00eengradit al persoanei la orice informa\u0163ie de interes public, definite astfel prin prezenta lege, constituie unul dintre principiile fundamentale ale rela\u0163iilor dintre persoane \u015fi autorit\u0103\u0163i publice, \u00een conformitate cu Constitu\u0163ia Rom\u00e2niei \u015fi cu documentele interna\u0163ionale ratificate ale Parlamentului Rom\u00e2niei.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Aplicarea real\u0103 a principiului transparen\u0163ei ar duce la o mai mare \u00eencredere \u00een legi \u015fi reglement\u0103ri, din moment ce ele au fost adoptate cu consultarea celor interesa\u0163i. \u00cencrederea \u00een cadrul legal va avea ca rezultat un mai mare grad de respectare a legii, cu urm\u0103ri pozitive asupra dezvolt\u0103rii economice \u015fi a men\u0163inerii unor rela\u0163ii de cooperare \u00eentre aparatul guvernametal \u015fi societate.<a href=\"#_ftn1\">[1]<\/a><strong> <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Transparentizarea autorit\u0103\u0163ilor publice este un proces dinamic. Pe masur\u0103 ce legea este din ce \u00een ce mai aplicat\u0103, autorit\u0103\u0163ile administra\u0163iei publice vor fi din ce \u00een ce mai transparente, pentru c\u0103 vor avea exerci\u0163iul aplic\u0103rii legii.<a href=\"#_ftn2\">[2]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Puterea administra\u0163iei publice \u00ee\u015fi g\u0103se\u015fte legitimitatea \u00een lege, care \u00eei recunoa\u015fte acesteia caracterul discre\u0163ionar, adecvat intereselor publice pe care trebuie s\u0103 le \u00eendeplineasc\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Felix si Loyd Nigro prezint\u0103 \u201edefini\u0163ia administra\u0163iei publice prin intermediul a cinci puncte:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">a)este un efort al unui grup care coopereaz\u0103 \u00eentr-un cadru public;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">b)acoper\u0103 cele trei ramuri-executiv\u0103,legislativ\u0103 \u015fi juridic\u0103 &#8211; \u015fi rela\u0163iile dintre ele;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">c)are un rol important \u00een formularea politicii publice \u015fi este de aceea o parte a procesului politic;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">d)este diferit\u0103 de administra\u0163ia privat\u0103 prin tr\u0103s\u0103turi seminificative;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">e)este asociat\u0103 de aproape cu numeroase grupuri private \u015fi de indivizi.\u201d<a href=\"#_ftn3\">[3]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Administra\u0163ia<\/strong> <strong>public\u0103<\/strong>&#8211; reprezint\u0103 o activitate de organizare a execut\u0103rii si executare in concret a legii prin intermediul institu\u0163iilor abilitate \u00een acest sens.Administra\u0163ia public\u0103 reprezint\u0103 o \u015ftiin\u0163\u0103 \u015fi \u00een acela\u015fi timp o art\u0103, prin intermediul careia se duc la \u00eendeplinire politicile statului. Guvernul \u00ee\u015fi atinge obiectivele prin intermediul administra\u0163iei publice deoarece aceasta traduce \u00eentr-un mod concret ceta\u0163eanului necesitatea aplic\u0103rii dar \u015fi respect\u0103rii legii.Administra\u0163ia are structurii proprii prin intermediul c\u0103rora pune \u00een aplicare prevederiile legii,\u015fi a celorlalte acte normative.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Administra\u0163ia public\u0103 este rezultatul muncii unui num\u0103r semificativ de persoane care \u00ee\u015fi desf\u0103\u015foar\u0103 activitatea \u00eentr-un spa\u0163iu public.Aceasta pentru a-\u015fi duce la bun\u0103 \u00eendeplinire scopul beneficiaz\u0103 de o serie de resurse \u015fi anume:umane \u015fi aici putem men\u0163iona poten\u0163ialul creativ al fiin\u0163ei umane,informa\u0163ionale,materiale \u015fi financiare.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Administra\u0163ia public\u0103<\/strong> &#8211; trebuie s\u0103 fie mereu preg\u0103tit\u0103 s\u0103 desf\u0103\u015foare ac\u0163iuni concrete cu efect direct \u015fi imediat astfel \u00eenc\u00e2t s\u0103 se poat\u0103 eviden\u0163ia \u00een fa\u0163a cet\u0103\u0163enilor,rezultatele nefiind \u00een unele cazuri cele mai favorabile.Administra\u0163ia se afl\u0103 \u00eentr-un continuu dialog cu grupurile sociale datorit\u0103 problemelor existente la nivelul comunit\u0103\u0163ii \u00een acest sens sunt institu\u0163ionalizate formele de consultare.Datorita acestui fapt grupurile,\u00ee\u015fi cunoasc bine drepturile \u015fi obliga\u0163iile \u015fi au sentimentul c\u0103 opinia lor \u00eentr-adev\u0103r conteaz\u0103.Nu acela\u015fi lucru se poate spune despre cet\u0103\u0163eni care consider\u0103 c\u0103 de cele mai multe ori punctul lor de vedere nu conteaz\u0103 \u015fi se simt abandona\u0163i de c\u0103tre administra\u0163ie.De asemenea trebuie s\u0103 subliniem faptul c\u0103 societetea per ansamblu are anumite a\u015ftept\u0103ri de la administra\u0163ie.\u00cen acest sens administra\u0163ia are anumite sarcini care sunt stabilite printr-un program guvernamental al partidului care iese \u00eenvingator \u00een alegeri.Sarcinile pot fi at\u00e2t de natur\u0103 economic\u0103,c\u00e2t \u015fi de natur\u0103 social\u0103 care pot fi transformate ulterior \u00een acte normative adoptate de Parlament. Apoi administra\u0163ia trebuie s\u0103 stabileasc\u0103 ordinea de prioritate a respectivelor sarcini \u015fi s\u0103 elaboreze m\u0103surile de aplicare \u00een concret a acestora. Pentru a duce la \u00eendeplinire sarcinile sale administra\u0163ia trebuie s\u0103 \u0163ina cont de condi\u0163iile de timp \u015fi de mediu,astfel ea beneficiaz\u0103 de putere discre\u0163ionar\u0103 fiind con\u015ftient\u0103 de rolul s\u0103u \u00een societate.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Societatea reprezint\u0103 principalul furnizor de valori sociale pentru administra\u0163ie,iar administra\u0163ia este cea care apreciaz\u0103 gradul de \u00eendeplinire al valorilor furnizate.Din aceast\u0103 cauz\u0103 \u201enu se poate vorbi de un sistem abstract de administra\u0163ie public\u0103,ci de un tip istoric,concret de administra\u0163ie public\u0103,\u00eentr-o \u0163ar\u0103 sau alta\u201d<a href=\"#_ftn4\">[4]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Alexandru Negoi\u0163\u0103 afirm\u0103 c\u0103\u201d administra\u0163ia public\u0103 pentru a putea s\u0103-\u015fi realizeze sarcinile sale are nevoie s\u0103 se sprijine pe puterea politic\u0103\u201d<a href=\"#_ftn5\">[5]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> Transparen\u0163a Decizional\u0103<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"> <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00cen Rom\u00e2nia, asigurarea transparen\u0163ei institu\u0163ionale este reglementat\u0103 de Legea nr. 52\/2003, care cuprinde prevederile legisla\u0163iei europene.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Cadrul \u015fi instrumentele lucr\u0103rii reliefate vor putea eviden\u0163ia rolul \u015fi importan\u0163a aplic\u0103rii acestor reglement\u0103ri at\u00e2t de necesare \u00een ceea ce priveste transparen\u0163a decizional\u0103 \u015fi implicit buna desf\u0103\u015furare a administra\u0163iei publice din Rom\u00e2nia.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong> Principiile bunei administra\u0163ii<\/strong> sunt urm\u0103toarele\u00a0: respectarea legii, lipsa discimin\u0103rii \u015fi tratamentului egal, propor\u0163ionalitatea, consecven\u0163a, obiectivitatea \u015fi impar\u0163ialitatea. Respectarea minimal\u0103 a acestora va garanta servicii publice administrative de o calitate superioar\u0103 \u015fi o mai bun\u0103 informare \u015fi implicare a comunit\u0103\u0163ii.<a href=\"#_ftn6\">[6]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Rela\u0163ia administra\u0163ie public\u0103 &#8211; cet\u0103\u0163eni a fost \u00eentotdeauna una destul de controversat\u0103, ambele p\u0103rti av\u00e2nd destul de multe lucruri de repro\u015fat una celeilalte. Lipsa de profesionalism a func\u0163ionarilor, birocra\u0163ia excesiv\u0103, corup\u0163ia care domne\u015fte peste tot dar oficial nu exist\u0103, mersul greoi al procedurilor administrative, lipsa de profesionalism \u00een rela\u0163iile cu publicul, aglomera\u0163ia, confuziile sau erorile angaja\u0163ilor, lipsa de informare \u00een randul publicului sunt \u00een mare, problemele care intervin \u00een aceasta rela\u0163ie administra\u0163ie-administra\u0163i.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Transparen\u0163a trebuie s\u0103 devin\u0103 o componenta esen\u0163ial\u0103 a institu\u0163iilor publice, ea este mai cur\u00e2nd o prevedere a legii, distan\u0163a dintre gradul actual de transparen\u0163\u0103 al institu\u0163iilor \u015fi obiectivele fixate prin lege fiind destul de \u00eensemnat\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Lipsa transparen\u0163ei \u201edecizionale, al\u0103turi de alte caren\u0163e ale activit\u0103\u0163ii de reglementare, conduce la \u00eencrederea sc\u0103zut\u0103 a societ\u0103\u0163ii \u00een for\u0163a \u015fi importan\u0163a actelor normative. Absen\u0163a consult\u0103rilor face ca normele s\u0103 fie frecvent modificate sau \u00eenlocuite, lucru ce determin\u0103 o accentuat\u0103 instabilitate legislativ\u0103 \u015fi nu ofer\u0103 siguran\u0163a necesar\u0103 cadrului legal existent \u00een Rom\u00e2nia. De asemenea un alt efect al lipsei transparen\u0163ei decizionale \u00een administra\u0163ia public\u0103 poate fi \u015fi este \u00een tara noastra, apari\u0163ia fenomenului de corup\u0163ie. Standardele de transparen\u0163\u0103 \u00een sectorul public, \u00een sistemul administrativ trebuie accentuate. Transparen\u0163a constituie una din premisele combaterii corup\u0163iei.\u201d<a href=\"#_ftn7\">[7]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Simptomele acestei instabilit\u0103\u0163i legislative sunt legate de o adevarat\u0103 infla\u0163ie legislativ\u0103, caracterizat\u0103 de unii ca o adevarata &#8222;orgie legislativ\u0103&#8221;.<a href=\"#_ftn8\">[8]<\/a> Astfel \u00een fiecare legislatur\u0103, Parlamentul edicteaz\u0103 legi noi, care se adaug\u0103 celor anterioare, care nu sunt abrogate. \u00cen \u0163ara noastr\u0103 fenomenul nu este absent.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Concret, \u201ctransparen\u0163a prive\u015fte ac\u0163iuni care au \u00een vedere\u00a0:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">a) informarea din oficiu a persoanelor asupra intereselor de ordin public care urmeaz\u0103 s\u0103 fie dezb\u0103tute de autorita\u0163ile administra\u0163iei publice centrale sau locale, precum \u015fi asupra proiectelor de acte normative;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">b) consultarea cet\u0103\u0163enilor \u015fi a asocia\u0163iilor legal constituite, la ini\u0163iativa autorit\u0103\u0163ilor publice, \u00een procesul de elaborare a proiectelor de acte normative;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">c) participarea activ\u0103 a cet\u0103\u0163enilor la luarea deciziilor administative \u015fi \u00een procesul de elaborare a proiectelor de acte normative.\u201d<a href=\"#_ftn9\">[9]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Conceptul de transparen\u0163\u0103 decizional\u0103 vine s\u0103 sus\u0163in\u0103 colaborarea tot mai str\u00e2ns\u0103 \u00eentre cet\u0103\u0163eni, pe de-o parte, \u015fi dintre cet\u0103\u0163eni \u015fi institu\u0163ii publice \u2013 centrale \u015fi\/sau locale, pe de alt\u0103 parte. Actorii interesa\u0163i \u00een aceast\u0103 transparen\u0163\u0103, au un cuv\u00e2nt important de spus, p\u0103rerile lor arat\u0103 un aspect important al implic\u0103rii precum \u015fi implementarea lor \u00eentr-o societate care tinde a fi una democratic\u0103 prin respectarea drepturilor fundamentale ale omului.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">&#8222;Cet\u0103\u0163enii&#8221; \u2013 \u00een majoritatea lor constituind un grup de oameni nemul\u0163umi\u0163i, av\u00e2nd o perspectiv\u0103 sumbr\u0103 \u015fi kafkian\u0103 asupra sistemului func\u0163ion\u0103resc. Nu \u00eensa \u00eentotdeauna \u00een cuno\u015ftiin\u0163\u0103 de cauz\u0103, mul\u0163i dintre ei av\u00e2nd o impresie negativ\u0103 \u00eenainte de a se confrunta cu sistemul. \u00cen fond, este bine cunoscut\u0103 predilec\u0163ia rom\u00e2nului de r\u00e2nd asupra formulelor generalizate prin care define\u015fte lumea ce \u00eel inconjoar\u0103. Majoritatea cet\u0103\u0163enilor sunt nemul\u0163umi\u0163i de modul cum func\u0163ioneaz\u0103 administra\u0163ia public\u0103, consider\u0103 c\u0103 to\u0163i func\u0163ionarii sunt corup\u0163i sau cel pu\u0163in coruptibili, sunt enerva\u0163i de sistemul de migrare de la un birou la altul \u015fi de lipsa de informare. Ei vor s\u0103 se implice \u00een luarea deciziilor \u00eentr-un sistem transparent.<a href=\"#_ftn10\">[10]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Una dintre responsabilit\u0103\u0163ile autorit\u0103\u0163ilor administra\u0163iei publice locale este s\u0103 permit\u0103 membrilor comunit\u0103\u0163ilor s\u0103 participe \u00een procesul de luare a deciziilor. Lipsa transparen\u0163ei \u00een via\u0163a politic\u0103 \u015fi \u00een actul de guvernare reprezint\u0103 unul dintre obstacolele cele mai greu de dep\u0103\u015fit c\u0103tre o societate democratic\u0103, \u00een care cet\u0103\u0163enii s\u0103 aib\u0103 \u00eencredere \u00een oamenii politici \u015fi \u00een guvernan\u0163i. De aceea, accesul ne\u00eengr\u0103dit al cet\u0103\u0163enilor la informa\u0163ia de interes public \u015fi participarea lor la luarea deciziilor sunt considerate dou\u0103 dintre premisele cele mai importante ale unei guvern\u0103ri democratice \u015fi responsabile.\u201d<a href=\"#_ftn15\">[15]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Informa\u0163ia le permite cet\u0103\u0163enilor, pe de o parte, s\u0103 aprecieze \u00een cuno\u015ftin\u0163\u0103 de cauz\u0103 ac\u0163iunile administra\u0163iei, iar pe de alt\u0103 parte, s\u0103 participe \u00een mod avizat la dezbaterile \u015fi la luarea deciziilor care \u00eei privesc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Importan\u0163a transparen\u0163ei decizionale se relev\u0103 din totalul actelor normative emise \u00een Rom\u00e2nia, majoritatea cov\u00e2r\u015fitoare sunt crea\u0163ia puterii executive. Dincolo de normele emise direct de c\u0103tre Guvern prin intermediul ordonan\u0163elor \u015fi a ordonan\u0163elor de urgen\u0163\u0103, marea majoritate a legilor adoptate de Parlament sunt ini\u0163iate de Guvern, fiind redactate \u00een cadrul institu\u0163iilor administra\u0163iei publice. \u00cen aplicarea legilor \u015fi ordonan\u0163elor, Guvernul, ministerele, alte institu\u0163ii statale centrale sau la nivel local, dar \u015fi toate institu\u0163iile administra\u0163iei publice locale emit \u00een mod continuu un mare num\u0103r de acte normative. style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00cen articolul 31 din Constitu\u0163ia Rom\u00e2niei se precizeaz\u0103 c\u0103 &#8221; dreptul persoanei de a avea acces la orice Ca principii de baz\u0103 ale activit\u0103\u0163ii CIC pot fi identificate informarea cet\u0103\u0163enilor, comunicarea cu ace\u015ftia, consultarea \u015fi implicarea cet\u0103\u0163enilor.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">CIC-ul func\u0163ioneaz\u0103 ca interfa\u0163\u0103 a administra\u0163iei publice, facilit\u00e2nd accesul publicului la serviciile oferite \u015fi informa\u0163iile de\u0163inute de c\u0103tre autoritatea public\u0103. Internetul nu este altceva dec\u00e2t o \u201eplatform\u0103 de dialog\u201d. \u00cen cazul monitoriz\u0103rii de fa\u0163\u0103, site-urile trebuie s\u0103 fie modalitatea prin care institu\u0163iile publice ofer\u0103 comunit\u0103\u0163ii informa\u0163ii pe care cet\u0103\u0163enii le preiau, le prelucreaz\u0103 \u00een func\u0163ie de necesit\u0103\u0163ile comunit\u0103\u0163ii \u015fi le ofer\u0103 administra\u0163iei. Circuitul continu\u0103 sistematic, st\u00e2nd la baza rela\u0163iilor comunitare, contribuind la buna func\u0163ionare a conceptului democratic de transparen\u0163\u0103 decizional\u0103. Cu toate acestea, utilizarea Internetului ca \u015fi liant \u00eentre comunitate \u015fi administra\u0163ia public\u0103 este departe de ceea ce ar trebui s\u0103 fie. respectiv\u0103. \u00ce\u015fi spore\u015fte astfel capacitatea de a lua hot\u0103r\u00e2ri \u015fi de a adopta acte normative coerente \u015fi adaptate nevoilor, care vor fi mai u\u015for acceptate \u015fi puse \u00een aplicare<a href=\"#_ftn35\">[35]<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>Articolul 19<\/em> in lucrarea <em>The Public\u2019s Right to Know: Principles on Freedom of Information Legislation<\/em>. \u00cen lucrarea men\u0163ionat\u0103, organiza\u0163ia <em>Articolul 19<\/em> define\u015fte urm\u0103toarele principii care ar trebui s\u0103 stea la baza reglement\u0103rii accesului la informa\u0163ie:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">1. <strong>principiul accesului maxim la informa\u0163ie<\/strong> \u2013 orice informa\u0163ie de\u0163inut\u0103 de o institu\u0163ie public\u0103 trebuie s\u0103 fie accesibil\u0103 publicului iar excep\u0163iile trebuiesc precis definite;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">2. <strong>obliga\u0163ia public\u0103rii informa\u0163iei<\/strong> &#8211;\u00a0 institu\u0163iile publice nu trebuie s\u0103 fac\u0103 doar accesibile informa\u0163iile la cerere, ci \u015fi s\u0103 dea publicit\u0103\u0163ii documente de interes public, \u00een limita capacit\u0103\u0163ii \u015fi resurselor de care dispun;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">3. <strong>promovarea transparen\u0163ei administrative<\/strong> &#8211; Guvernul \u015fi institu\u0163iile publice trebuie s\u0103 \u00eencurajeze o cultur\u0103 civic\u0103 \u015fi institu\u0163ional\u0103 a transparen\u0163ei \u015fi s\u0103 asigure resursele necesare pentru promovarea public\u0103 a urm\u0103toarelor obiective:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u2022 campanii de informare public\u0103 privind dreptul de acces la informa\u0163ie;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u2022 programe de educa\u0163ie public\u0103 privind exercitarea acestui drept;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u2022 diminuarea culturii secretului \u00een institu\u0163ii publice prin programe de instruire a func\u0163ionarilor pentru aplicarea legisla\u0163iei privind accesul la informa\u0163ie.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">1.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>definirea limitativ\u0103 a excep\u0163iilor<\/strong> \u2013 informa\u0163iile exceptate de la accesul liber trebuie s\u0103 fie strict definite de la caz la caz, iar refuzul de a permite accesul la informa\u0163ie trebuie s\u0103 satisfac\u0103 un test cu trei dimensiuni:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>\u2022<\/strong> informarea respectiv\u0103 este legat\u0103 de un interes legitim men\u0163ionat prin lege;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>\u2022 <\/strong>accesul la informa\u0163ia respectiv\u0103 pericliteaz\u0103 protejarea acestui scop;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>\u2022 <\/strong>periclitarea acestui scop este mai important\u0103 dec\u00e2t interesul public de a avea acces la informa\u0163ia respactiv\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">2.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>introducerea unor proceduri de facilitare a accesului la informa\u0163ie \u2013 <\/strong>solicit\u0103rile de acces la informa\u0163ie trebuie procesate rapid, de compartimente specializate \u015fi existen\u0163a sanc\u0163iunilor \u015fi a posibilit\u0103\u0163ilor de apel \u00eempotriva refuz\u0103rii accesului trebuie asigurat\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">3.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>nivelul rezonabil al costurilor accesului la informa\u0163ie \u2013<\/strong> accesul la informa\u0163ie nu trebuie descurajat printr-un nivel excesiv al taxelor percepute solicitan\u0163ilor.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">4.\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0<strong>caracterul public al \u015fedin\u0163elor institu\u0163iilor publice \u2013 <\/strong>\u015fedintele institu\u0163iilor publice trebuiesc anun\u0163ate \u00een prealabil \u015fi s\u0103 fie deschise publicului, excep\u0163iile de la aceasta regul\u0103 trebuie s\u0103 fie definite precis \u015fi limitativ.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">5.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>prioritatea accesului la informa\u0163ie \u2013 <\/strong>legea privind accesul la informa\u0163ie trebuie s\u0103 stipuleze c\u0103 orice alt act normativ va fi interpretat \u00een conformitate cu prevederile sale \u015fi s\u0103 previn\u0103 riscul ca regimul excep\u0163iilor s\u0103 fie extins \u00een mod arbitrar prin alte reglement\u0103ri.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">6.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>protec\u0163ia avertizorilor de integritate \u2013<\/strong> personele care reclam\u0103 ori sesizeaz\u0103, cu bun\u0103 credin\u0163\u0103, \u00eenc\u0103lc\u0103ri ale legii nu pot fi sanc\u0163ionate, prin aplicarea unei sanc\u0163iuni inechitabile sau mai severe pentru alte abateri disciplinare, chiar dac\u0103 prin acest fel dau publicita\u0163ii informa\u0163ii exceptate de la accesul public.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">C\u00e2nd vorbim de liberul acces la informa\u0163iile de interes public ne referim la posibilitatea oric\u0103rei persoane\u00a0 de a ob\u0163ine informa\u0163ii ce sunt de\u0163inute de institu\u0163ii ale statului.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Administra\u0163ia public\u0103 reprezint\u0103 palierul de
